Preamble

Your lessons are given by independent, state-certified ski instructors. Skibex books, invoices and collects payment for them in their name and on their behalf: your invoice shows your instructor's name and business number.

Article 1 — Booking and payment

Bookings can be made on the website, by message or by phone, subject to instructor availability. A booking is confirmed once the full price has been paid, by card or by any other method offered by our payment provider Stripe; a card hold is placed when the request is made and the card is charged once Skibex confirms the booking. A confirmation is sent by e-mail.

Payment data is processed by Stripe and is not stored by Skibex. Personal data is used only to handle the booking and deliver the lessons, in accordance with our privacy policy.

Article 2 — Prices

Prices are shown in euros, all taxes included, according to the price list in force on the day of booking. A supplement may apply above 4 participants per lesson; it is shown before payment. Lessons are exempt from VAT under article 261, 4-4° b of the French General Tax Code.

Article 3 — No right of withdrawal

Under article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or for a specific period. Lessons booked for a specific date therefore cannot be withdrawn from; the cancellation terms in article 4 apply. Where applicable, a gift voucher with no set date may be cancelled within 14 days of purchase.

Article 4 — Cancellation by the client

Refunds are calculated on the total price of the lessons booked:

cancellation 20 days or more before the first lesson: 95% refund (5% is kept for booking and payment fees);
cancellation between 19 and 12 days before the first lesson: 50% refund;
cancellation less than 12 days before the first lesson: no refund.

No refund or rescheduling is due when the client does not take part in, or stops, the lesson for reasons on their side: lateness, absence, illness, accident, insufficient fitness or technical level.

Article 5 — Changes to a booking

A booking can be changed (time, number of participants, level) up to 2 days before the first lesson, subject to instructor availability and payment of any supplement. No change is possible within the 2 days before the lesson.

Article 6 — Weather, resort closure and safety

The instructor decides whether a lesson can go ahead based on the weather, snow conditions, lift and slope openings and the participants' level. The instructor may adapt the location or programme for safety reasons; an adapted lesson does not give rise to a refund.

If a lesson cannot take place at all on the planned date at the initiative of the instructor or of Skibex (dangerous conditions, resort closure, instructor unavailable), Skibex will first offer to reschedule. If no new date can be agreed, the lessons not delivered are refunded.

Article 7 — Participation and safety

Participants must be in good health, have suitable equipment in good condition, have the level required for the chosen activity and follow the instructor's instructions at all times. Some activities (off-piste, ski touring, guided skiing) require a minimum level, stated at booking. Helmets are mandatory for children and strongly recommended for everyone. Lift passes are not included in the price unless stated otherwise.

Article 8 — Minors

A minor may only take part with the consent of their legal guardian, who provides at booking a phone number reachable during the lesson and any relevant health information.

Article 9 — Liability

Each lesson is delivered under the professional responsibility of the instructor who gives it. The instructor is bound by an obligation of means and holds professional liability insurance. Skibex, as agent, is responsible for organising the booking, invoicing and payment collection. Clients remain liable for any damage they cause themselves, in particular to other users of the ski area; personal liability insurance is recommended.

Article 10 — Insurance

Skibex holds professional civil liability insurance with MMA IARD, 160 rue Henri Champion, 72030 Le Mans Cedex 9, France (MMA Pro-PME policy no. 150 788 303), valid worldwide except the United States and Canada. Each instructor holds professional liability insurance. The client's personal insurance (illness, accident, repatriation, rescue costs, cancellation) is not included.

Rescue costs on and off the slopes may be charged to the rescued person by the local authority: insurance covering winter sports is strongly recommended; it is mandatory for off-piste and ski touring. On request, Skibex provides the supporting documents needed for an insurance claim (invoice, cancellation certificate).

Article 11 — Use of images

Photos and videos may be taken during activities and used to promote Skibex and its instructors, unless the client objects in writing before or during the activity.

Article 12 — Force majeure

Neither the instructor nor Skibex can be held liable for non-performance caused by force majeure (natural disaster, strike, epidemic, administrative closure). In that case, article 6 applies.

Article 13 — Complaints and mediation

Complaints should be sent to [email protected]. Article 14 — Governing law

These terms are governed by French law. In the event of a dispute, a consumer client may bring the matter before the competent court under the rules of the French Consumer Code.
